Each competent Italian Consulate abroad or foreign Consulate in Italy also operates according to methods that are always variable and at the sole discretion of the consular authorities in service at the time.

Bureaucratic delays in international matters are always quite long, as Consulates are often cumbersome and slow, and municipal officials who are truly competent in international procedures and have proven experience are few (especially in small municipalities).
In relation to weddings to be celebrated in Italy, involving
people coming from abroad or of foreign nationality,
Three cases can be generally distinguished:

Both spouses are foreign nationals

One spouse is of foreign nationality and one spouse is of Italian nationality

One or both spouses are registered in AIRE (Registry of Italians Resident Abroad)
Procedures to follow for submitting their documentation
at the Municipal Marriage Office
Both spouses of foreign nationality
If both spouses are foreign nationals, the documents usually required by the Italian municipality for the marriage banns are:
- Marriage permit issued by the foreign national's competent consulate, or a certificate of capacity to marry issued by the competent foreign authorities
- Birth certificate (with indication of paternity and maternity)
- Certificate of single status (or equivalent document)
A spouse of foreign nationality, a spouse of Italian nationality
If one spouse is an Italian national, the documents usually required by the Italian municipality for the marriage banns of the foreign person are:
- Marriage permit issued by the Consulate responsible for the foreign person, or a certificate of capacity to marry issued by the competent foreign authorities
- Birth certificate (with indication of paternity and maternity)
- Certificate of single status (or equivalent document) at the discretion of the Municipality
For Italians, the documents usually required by the foreign consulate in order to issue the marriage permit are:
- Birth certificate (with indication of paternity and maternity)
- Certificate of civil status (or equivalent document)
One or both spouses are Italian nationals, but resident abroad (AIRE)
If at least one of the two spouses (or both) is/are Italian nationals, but resident abroad and registered in the Registry of Italians Resident Abroad (AIRE), the marriage banns must necessarily be requested from the Italian consular representation in the foreign country of residence.
Normally (but not always) the Italian Consulate should forward the banns to the Italian municipality where the marriage is celebrated; we recommend contacting the Consulate and checking with the municipality to ensure this is actually done promptly.
The Municipality still has the right to request the following documents for the foreign person, even though they are virtually useless compared to the marriage banns issued by the consular representation:
- Birth certificate (with indication of paternity and maternity)
- Certificate of civil status (or equivalent document)
All original certificates must be
legalized with Apostille or
at the competent Italian Consulate and provide the relevant information
sworn translations to the Town Hall where the marriage banns will be published and the wedding celebrated.
In case one or both spouses are
divorced or
widowers , it will be necessary to present appropriate documentation, which varies from case to case and from country to country.
THE
Marriage Clearances issued by the competent Consulate in Italy must be legalized at the competent Prefecture.
